If I am a Massachusetts-based employer, and I send one of my employees on a brief overseas trip, does my Massachusetts Workers Compensation extend coverage for that employee?
The answer is typically, yes! Assuming that that time spent overseas was incidental to normal operations. However, it may be wise to consider additional coverage because if an employee is injured while executing your business overseas, there are usually additional expenses to get them back home that may not be covered by your regular Workers Compensation in MA.
Additionally, there are endorsements that you can purchase (i.e. Foreign Voluntary Workers Compensation) for employees that spend time overseas on more than a supplementary basis. This will provide both you and the employee with added coverage in the event of a covered loss – which, as mentioned above, can be quite costly!
However, the best advice is to contact your local Massachusetts Business Insurance agent to find out how your specific situation should be covered and if by not having extra coverage for traveling employees you are leaving you and your business vulnerable to expensive claims and legal repercussions!
